Having this expertise is one key role that Congressional staff and lobbyists play in American politics, and the legalistic nature of the debates, while inevitable in a democracy, seem particularly perverse in their outcomes in the US. Fukuyama is good on this issue in his second volume of the book Political Order, which this below summarises:
